Section 52(2)

If the regulator fails to give notice under paragraph (1) within the period required by that paragraph, the information subject may give notice to the regulator of that failure, and on such notice— the regulator is deemed to have determined that the information must be included on the register, and the deemed determination is subject to the right of appeal in regulation 53(1).
