Section 12(8)

In applying the Annex III criteria, the appropriate authority must— in relation to the application of stage 1 of the Annex III criteria, have regard to the advice of the appropriate nature conservation body; and in relation to the application of stage 2 of the Annex III criteria, have regard to the advice of the Joint Nature Conservation Committee.
