Section 76
Subject to paragraphs (2) to (4), the 2011 Regulations are revoked. Notwithstanding the revocation in paragraph (1), the 2011 Regulations continue to apply where before the commencement of these Regulations— an applicant, appellant or qualifying body, as the case may be, has submitted an environmental statement or requested a scoping opinion; or in respect of local development orders, the local planning authority has in connection with that order prepared an environmental statement or a scoping opinion or requested a scoping direction. Notwithstanding the revocation in paragraph (1), Parts 1 and 2 of the 2011 Regulations continue to apply to— where, before the coming into force of these Regulations, such requests were made or the relevant planning authority or the Secretary of State, as the case may be, initiated the making or adoption of such screening opinions or screening directions. requests for a screening opinion or direction; screening opinions adopted by the relevant planning authority; and screening directions made by the Secretary of State; In this regulation— “the 2011 Regulations” means the Town and Country Planning (Environmental Impact Assessment) Regulations 2011 ; and “environmental statement”, “scoping direction”, “scoping opinion”, “screening direction and “screening opinion” have the meanings given by regulation 2 of the 2011 Regulations.
