Section 72(6)

In the application of this regulation to Scotland, the references in paragraphs (1) and (5)— to proceedings in the High Court are to be read as references to proceedings in the Court of Session; and to an entitlement on grounds of legal professional privilege are to be read as references to an entitlement on the grounds of confidentiality of communication— between professional legal advisers and their clients; or made in connection with or in contemplation of legal proceedings and for the purposes of those proceedings.
