Schedule 1, Part 4, paragraph 18(2)

Section 133 of the Act (proceedings before the Tribunal: general provision) applies as if— in subsection (1)— “(whether made under this or any other Act)” were omitted; paragraphs (b) and (c) were omitted; in subsection (2), “, (b) or (c)” were omitted; in subsection (5) the reference to section 393(11) were a reference to section 393(11) as applied by these Regulations; for subsection (7A) there were substituted— A reference is a “disciplinary reference” for the purposes of this section if it is in respect of either of the following decisions— a decision to publish a statement under paragraph 10 of Schedule 1 to the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017; a decision to impose a penalty under paragraph 11 of Schedule 1 to those Regulations.
