Schedule 2, paragraph 48

In section 398(1A) (Misleading FCA or PRA: residual cases)— after paragraph (b) insert— the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017 (S.I. 2017/701); at the end of paragraph (e) omit “or”; and after paragraph (e) insert— any directly applicable EU regulation made under the markets in financial instruments directive; the markets in financial instruments regulation and any directly applicable EU regulation made under it; or
