Schedule 8, Part 2, paragraph 5(30)

In Schedule 2 (capital requirements)— in paragraph 1 for “the items specified in paragraph 4(a), (b) and (c) of this Schedule” substitute “ one or more of the items specified in Article 26(1)(a) to (e) of the capital requirements regulation ”; in paragraph 4 for “the following items” to the end substitute “ own funds as defined in Article 4(1)(18) of the capital requirements regulation, and are to be calculated in accordance with paragraphs 9 to 12. ”; omit paragraphs 5 to 8 and the heading preceding paragraph 7; for paragraph 9 substitute— For the purposes of calculating own funds— the amount of Tier 2 capital must be equal to or less than one third of the amount of Tier 1 capital; at least 75% of the amount of Tier 1 capital must be in the form of Common Equity Tier 1 capital. in paragraph 13(a) after “payment services” insert “ specified in paragraph 1(a) to (f) of Schedule 1 of the Payment Services Regulations 2017. ”; in paragraph 21(4)— in paragraph (a) for “2009” substitute “ 2017 ”; omit paragraph (b); in paragraph (c) after “payment service” insert “ specified in paragraph 1(a) to (e) of Schedule 1 to those Regulations ”.
