Section 53(4)

Paragraph (1) does not require a payment service provider to provide information where— the information has been, or is to be, provided or made available as required by the payer under a condition of the type referred to in paragraph (3); or more than one month has passed since information was last provided, but there are no payment transactions in respect of which the payment service provider has not previously provided or made available information in accordance with paragraph (1) or as required by the payer under a condition of the type referred to in paragraph (3).
