Section 61ZC

A person does not contravene the prohibition in regulation 57ZA(2) (operating specified ships) by conduct in the United Kingdom or in the territorial sea where the person— is not a United Kingdom person, and the person’s presence in the United Kingdom or in the territorial sea arises directly from an exercise of either— in accordance with the provisions of the United Nations Convention on the Law of the Sea. the right of innocent passage, or the right of transit passage, A person does not contravene the prohibition in regulation 57ZA(2) by conduct necessary to protect or avoid endangering— the safety of any ship, or the life of any person.
