caution against first registration — a caution lodged under section 15 Section 132(1)
cautions register — the register kept under section 19(1) Section 132(1)
charge — any mortgage, charge or lien for securing money or money’s worth Section 132(1)
company — a company as defined in section 1(1) of the Companies Act 2006 Section 106(2)
Crown interest — an interest belonging to Her Majesty in right of the Crown, or belonging to a government department, or held in trust for Her Majesty for the purposes of a government department Section 83(2)
demesne land — land belonging to Her Majesty in right of the Crown which is not held for an estate in fee simple absolute in possession;
“dwelling-house” has the same meaning as in Part 1 of the Housing Act 1988;
“flexible tenancy” has the meaning given by section 107A of the Housing Act 1985;
“land” includes—
buildings and other structures,
land covered with water, and
mines and minerals, whether or not held with the surface Section 132(1)
Duchy interest — an interest belonging to Her Majesty in right of the Duchy of Lancaster, or belonging to the Duchy of Cornwall Section 83(2)
exempt overseas entity — an overseas entity of a description specified in regulations under section 34(6) of the Economic Crime (Transparency and Enforcement) Act 2022;
“overseas entity” has the meaning given by section 2 of the Economic Crime (Transparency and Enforcement) Act 2022;
“qualifying estate” has the meaning given by paragraph 1 Schedule 4A, paragraph 7
foreshore — the shore and bed of the sea and of any tidal water, below the line of the medium high tide between the spring and neap tides Schedule 6, paragraph 13(3)
interest — any estate, interest or charge in or over land and any right or claim in relation to land Section 83(2)
invest — invest in any way (whether by acquiring assets, securities or rights or otherwise) Section 106(2)
land registration rules — any rules under this Act, other than rules under section 93, Part 11, section 121 or paragraph 1, 2 or 3 of Schedule 5;
“legal estate” has the same meaning as in the Law of Property Act 1925 (c. 20);
“legal mortgage” has the same meaning as in the Law of Property Act 1925 Section 132(1)
land registry network — a network provided under section 92(1);
“network access agreement” has the meaning given by paragraph 1(2) Schedule 5, paragraph 12
legal sub-mortgage — —
a transfer by way of mortgage,
a sub-mortgage by sub-demise, and
a charge by way of legal mortgage Section 23(3)
long tenancy — a tenancy granted for a term certain of more than 21 years, whether or not it is (or may become) terminable before the end of that term by notice given by the tenant or by re-entry or forfeiture;
“mines and minerals” includes any strata or seam of minerals or substances in or under any land, and powers of working and getting any such minerals or substances Section 132(1)
mental disability — a disability or disorder of the mind or brain, whether permanent or temporary, which results in an impairment or disturbance of mental functioning Schedule 6, paragraph 8(3)
monitoring information — information provided in pursuance of provision in a network access agreement included under paragraph 2(2)(c) Schedule 5, paragraph 9(3)
network transaction — a transaction carried on by means of a land registry network Schedule 5, paragraph 12
qualifying estate — —
a freehold estate in land, or
a leasehold estate in land granted for a term of more than seven years from the date of grant Schedule 4A, paragraph 1
qualifying transaction — a transaction which—
involves registration, and
is capable of being effected electronically Schedule 5, paragraph 12
register — the register of title, except in the context of cautions against first registration Section 132(1)
register of overseas entities — the register kept under section 3 of the Economic Crime (Transparency and Enforcement) Act 2022 Schedule 4A, paragraph 7
register of title — the register kept under section 1 of the Land Registration Act 2002 Schedule 11, paragraph 7(5)
registered — entered in the register Section 132(1)
registered charge — a charge the title to which is entered in the register Section 132(1)
registered estate — a legal estate the title to which is entered in the register, other than a registered charge Section 132(1)
registered land — a registered estate or registered charge Section 132(1)
registered land — an interest the title to which is, or is required to be, registered Section 89(3)
registered overseas entity — an overseas entity that is registered in the register of overseas entities (but see paragraph 8) Schedule 4A, paragraph 7
registrable disposition — a disposition which is required to be completed by registration under section 27 Section 132(1)
registrar — the Chief Land Registrar Section 132(1)
relevant social housing tenancy — —
(a) a flexible tenancy, or
(b) an assured tenancy of a dwelling-house in England granted by a private registered provider of social housing, other than a long tenancy or a shared ownership lease Section 132(1)
requirement of registration — the requirement of registration under section 4 Section 132(1)
shared ownership lease — a lease of a dwelling-house—
(a) granted on payment of a premium calculated by reference to a percentage of the value of the dwelling-house or of the cost of providing it, or
(b) under which the lessee (or the lessee's personal representatives) will or may be entitled to a sum calculated by reference, directly or indirectly, to the value of the dwelling-house Section 132(1)
specified circumstances — circumstances specified in regulations made by the Secretary of State for the purposes of that paragraph Schedule 4A, paragraph 3(3)
specified insolvency practitioner — an insolvency practitioner of a description specified in regulations made by the Secretary of State for the purposes of that paragraph Schedule 4A, paragraph 3(3)
sub-charge — a charge under section 23(2)(b);
“term of years absolute” has the same meaning as in the Law of Property Act 1925 (c. 20);
“valuable consideration” does not include marriage consideration or a nominal consideration in money Section 132(1)
the appropriate authority — —
in relation to an interest belonging to Her Majesty in right of the Crown and forming part of the Crown Estate, the Crown Estate Commissioners;
in relation to any other interest belonging to Her Majesty in right of the Crown, the government department having the management of the interest or, if there is no such department, such person as Her Majesty may appoint in writing under the Royal Sign Manual;
in relation to an interest belonging to Her Majesty in right of the Duchy of Lancaster, the Chancellor of the Duchy;
in relation to an interest belonging to the Duchy of Cornwall, such person as the Duke of Cornwall, or the possessor for the time being of the Duchy of Cornwall, appoints;
in relation to an interest belonging to a government department, or held in trust for Her Majesty for the purposes of a government department, that department Section 83(2)
the maximum summary term for either-way offences — —
in relation to an offence committed before the time when paragraph 24(2) of Schedule 22 to the Sentencing Act 2020 comes into force, 6 months;
in relation to an offence committed after that time, 12 months Schedule 4A, paragraph 6(8)
unilateral notice — a notice entered in the register in pursuance of an application under section 34(2)(b) Section 36(4)
