Home Member States under Article 2(1)(i) may provide that voting rights held in the trading book, as defined in Article 2(6) of Council Directive 93/6/EEC of 15 March 1993 on the capital adequacy of investment firms and credit institutions OJ L 141, 11.6.1993, p. 1. Directive as last amended by Directive 2004/39/EC. , of a credit institution or investment firm shall not be counted for the purposes of this Article provided that: the voting rights held in the trading book do not exceed 5 %, and the credit institution or investment firm ensures that the voting rights attaching to shares held in the trading book are not exercised nor otherwise used to intervene in the management of the issuer.
