Article 40 — Right of appeal
Member States shall ensure that decisions taken under this Regulation are properly reasoned and subject to a right of appeal before a tribunal. For the purposes of Article 20, a right of appeal shall also apply where the competent authority has neither taken a decision to approve or to refuse an application for approval nor has made any request for changes or supplementary information within the time limits set out in Article 20(2), (3) and (6) in respect of that application.
