Member States shall ensure that the following categories of information obtained by a party during enforcement proceedings before a national competition authority shall not be used by that party in proceedings before national courts before the national competition authority has closed its enforcement proceedings with respect to all parties under investigation by adopting a decision referred to in Article 10 or Article 12 or otherwise has terminated its proceedings: (a) information that was prepared by other natural or legal persons specifically for the enforcement proceedings of the national competition authority; (b) information that the national competition authority has drawn up and sent to the parties in the course of its enforcement proceedings; and (c) settlement submissions that have been withdrawn.
