Unbeschadet etwaiger Verpflichtungen, die sich aus den anwendbaren Harmonisierungsrechtsvorschriften der Union ergeben, darf ein Produkt, das den in Absatz 5 genannten Rechtsvorschriften unterliegt, nur in Verkehr gebracht werden, wenn ein in der Union niedergelassener Wirtschaftsakteur für dieses Produkt für die in Absatz 3 genannten Aufgaben verantwortlich ist.
