In exercising his powers under subsection (6), the Secretary of State must take into account, as between the appellant and any of the other people referred to in subsection (2)— their relative interests in the land (considering both the nature of the interests and the rights and obligations arising under or by virtue of them); their relative responsibility for the state of the land which gives rise to the requirements of the management notice; and the relative degree of benefit to be derived from carrying out the requirements of the management notice.
