Section 137(2)

If a lessee fails to give notice as required by subsection (1), he shall be liable to forfeit to the person of whom he holds the land an amount equal to the value of 3 years’ improved or rack rent of the land to be recovered by action in the county court or any other court having jurisdiction in respect of claims for such an amount.
