Section 237(4)

The question whether industrial action is to be so taken in any case shall be determined by reference to the facts as at the time of dismissal. Provided that, where an act is repudiated as mentioned in section 21, industrial action shall not thereby be treated as unofficial before the end of the next working day after the day on which the repudiation takes place.
