Schedule 2A, Part 1, paragraph 10(2)

Where the reputation of a comparable trade mark (EU) falls to be considered in respect of any time before IP completion day, references in sections 5(3) and 10(3) to— the reputation of the mark are to be treated as references to the reputation of the corresponding EUTM; and the United Kingdom include the European Union.
