Schedule 2A, Part 1, paragraph 11

Section 9 applies in relation to a comparable trade mark (EU) but as if— the words in brackets in subsection (3) referring to section 40(3) were replaced with a reference to paragraph 1(4) of this Schedule; and the proviso in subsection (3) were omitted.
