Schedule 2, Part I, paragraph 3(7)

In a case falling within sub-paragraph (5) above, for the purposes of Chapter I of Part XIV of the Employment Rights Act 1996 (ascertainment of the length of an employee’s period of employment and whether that employment is continuous)— so much of the qualifying employee’s period of continuous employment as ends with the day preceding the transfer date shall be treated on and after that date as a period of employment with the relevant new Agency; and the continuity of the period of employment of the qualifying employee shall be treated as not having been broken by the transfer.
