An employee who is dismissed is to be regarded for the purposes of this Part as unfairly dismissed if— the employee was employed for the purposes of a business carried on by the employer, and the reason (or, if more than one, the principal reason) for the dismissal is to enable the employer to replace the employee with an individual who is not an employee of the employer.
