Section 27BA(11)

Where this subsection applies— subsection (3)(a)(ii) is to apply as if the contract or arrangement required the employer to make work available to the worker during the reference period for the apportioned number of the unassigned hours (in addition to any other hours that the employer is required to make available to the worker during the reference period); “the apportioned number” of the unassigned hours is— where— H is the number of the unassigned hours, D1 is the number of days in the reference period that fall within the longer period, and D2 is the number of days in the longer period.
