Subsection (6) applies in a case where— an employer receives a request from a worker under subsection (3) for records in relation to a place of business of the employer, the employer is not required by this section to maintain those records, but the employer would be required by this section to maintain those records if worker-received tips paid at, or otherwise attributable to, the place of business were qualifying tips, gratuities and service charges.
