Section 72(5)

Section 33(1)(c) of the 1974 Act shall not apply in relation to the prohibition under subsection (1); and an employer who contravenes that subsection shall be— guilty of an offence, and liable on summary conviction to a fine not exceeding level 2 on the standard scale.
