Schedule 11, paragraph 31(18)

In Schedule 2 (financial investigations) in paragraph 3A— in sub-paragraph (1) for “any conduct to which Article 49 applies” substitute “ his criminal conduct ”; after that paragraph insert— For the purposes of sub-paragraph (1) the question whether a person has benefited from his criminal conduct is to be decided in accordance with Part 4 of the Proceeds of Crime Act 2002.
