Schedule 5, Part 3, paragraph 16D(2)

The grounds for an appeal under sub-paragraph (1)(a) or (b)are that— the decision to impose a monetary penalty was based on an error of fact, the decision was wrong in law, the amount of the penalty is unreasonable, or the decision was unreasonable or wrong for any other reason.
