A domestic enforcer may exercise the power in paragraph 30A (power to decommission or switch off fixed medical devices)— if an officer of the enforcer reasonably suspects a breach of— the Medical Devices Regulations 2002 (S.I. 2002/618), regulations made under section 15(1) of the Medicines and Medical Devices Act 2021, the Medical Devices (Northern Ireland Protocol) Regulations 2021, ... Regulation (EU) 2017/745 on medical devices, ... or Regulation (EU) 2017/746 on in vitro diagnostic medical devices, and for the purpose of ascertaining (by means of testing or otherwise) whether there has been such a breach.
