Schedule 7, paragraph 8(10)

In the case of an undertaking under section 219, “a loss case” means a case in which— subsection (3)(a) or (b) of that section applies (a belief that a person has engaged or is engaging in conduct which constitutes an infringement), and consumers have suffered loss as a result of that conduct.
