Section 55(5)

A statutory instrument containing (whether alone or with other provision)— may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament. regulations under section 1 that repeal, revoke or amend any provision of primary legislation, section 39(2A), regulations under section 47, regulations under section 48, or regulations under section 49, This subsection does not apply to a statutory instrument to which subsection (3) applies by virtue of subsection (2).
