Schedule 10, Part 1, paragraph 11

Section 42 (offences) is amended as follows. For the heading substitute “Obstruction”. After subsection (7) insert— A person is not guilty of an offence under subsection (5) or (7) by reason of any act or omission in relation to which the CMA has proceeded against the person under section 40ZE(1).
