Schedule 13, paragraph 17(3)

The CMA’s power to give a notice under section 174(4) or (5) to a person outside the United Kingdom by virtue of subsection (2)(a) is exercisable only if the person— is a United Kingdom national; is an individual who is habitually resident in the United Kingdom; is a body incorporated under the law of any part of the United Kingdom; carries on business in the United Kingdom.
