In sub-paragraph (2) (functions which cannot be delegated), at the end insert— whether to begin an initial SMS investigation under section 9 of the Digital Markets, Competition and Consumers Act 2024 (“the 2024 Act”); whether to begin a further SMS investigation under section 10 of the 2024 Act; whether to begin a PCI investigation under section 47 of the 2024 Act.
