Section 216(4)

In paragraph 6 of Schedule 10 (procedure for and appeals against financial penalties imposed under section 93: recovery)— in sub-paragraph (2) for “local weights and measures” substitute “enforcement”; in sub-paragraph (4) for “the Department of Enterprise, Trade and Investment” substitute “the enforcement authority which imposed the financial penalty”; in sub-paragraph (5)(a) after “Investment” insert “or by the Competition and Markets Authority”; after sub-paragraph (7) insert— The Competition and Markets Authority may use the proceeds of a financial penalty for the purposes of any of its functions (whether or not the function is expressed to be a function of the Authority).
