Section 238(1)

It is a defence for a person (“the defendant”) charged with an offence under subsection (1), (2), (3), (6) or (7) of section 237 to prove— that the commission of the offence was due to— the act or omission of another person, reliance on information given by another person, a mistake or accident, or another cause beyond the defendant’s control, and that the defendant took all reasonable precautions and exercised all due diligence to avoid the commission of such an offence by the defendant or any other person under the defendant’s control.
