Section 18(10)

Subject to paragraphs (12) and (13), where a tribunal orders compensation under paragraph (8)(b), the amount of the compensation awarded shall be such as the tribunal considers just and equitable in all the circumstances having regard to— the infringement or breach to which the complaint relates; and any loss which is attributable to the infringement.
