Schedule 1, Part 4, paragraph 19(7)
Section 168 of the Act (appointment of persons to carry out investigations in particular cases) applies as if— for subsection (1) there were substituted— Subsection (3) applies if it appears to an investigating authority that there are circumstances suggesting that— a person may have contravened a requirement imposed by or under the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017 or by Article 28 of the markets in financial instruments regulation; a member of the management body of a person referred to in paragraph (a) or another member of the senior management of such a person may be responsible for the contravention of a requirement imposed by or under the Financial Services and Markets Act 2000 (Markets in Financial Instruments) Regulations 2017 or by Article 28 of the markets in financial instruments regulation; or a person may be guilty of an offence under those Regulations or under this Act as applied by those Regulations. subsections (2), (4) and (5) were omitted; for subsection (6) there were substituted— “Investigating authority” means the FCA or the PRA.
