Section 31(3)

A person (P) does not incur any liability under regulation 30 for failing to disclose— in a case where P is responsible for a prospectus, information which P is entitled to omit by virtue of regulation 25; in a case where P is not responsible for a prospectus, information which P would not be required to disclose in a prospectus if P were responsible for the prospectus.
