Section 27BD(1)

The duty imposed by section 27BA(1) on an employer in relation to a qualifying worker does not apply if during the relevant reference period or the offer period there is a relevant termination of— the worker’s contract under which the qualifying worker has been working for the employer, or the arrangement in accordance with the terms of which the qualifying worker has been working for the employer.
