ADR entity — a person who carries out ADR in compliance with section 293(1) of that Act (which prohibits persons from carrying out ADR unless exempt, accredited, or acting under special ADR arrangements, in accordance with Chapter 4 of Part 4 of that Act); “consumer contract dispute” has the same meaning as in Chapter 4 of Part 4 of that Act Section 140AA(1)

Advocate — a practising member of the Faculty of Advocates Section 48(9)

age condition — a condition specified in an order under subsection (1) of section 19A of that Act requiring the age of certain persons to be verified in the manner specified in the condition before they are served alcohol in premises where the condition applies Schedule 3, Part 7, paragraph 30C(4)

appropriate authority — — in relation to transport facilities in England and Wales, the Secretary of State; in relation to transport facilities in Scotland, the Scottish Ministers Section 162(3)

armed forces — any of the naval, military or air forces of the Crown Section 212(1)

assistance dog — — a dog which has been trained to guide a blind person; a dog which has been trained to assist a deaf person; a dog which has been trained by a prescribed charity to assist a disabled person who has a disability that consists of epilepsy or otherwise affects the person's mobility, manual dexterity, physical co-ordination or ability to lift, carry or otherwise move everyday objects; a dog of a prescribed category which has been trained to assist a disabled person who has a disability (other than one falling within paragraph (c)) of a prescribed kind; “operator”, in relation to a private hire vehicle— means a person who holds a licence under— section 55 of the Local Government (Miscellaneous Provisions) Act 1976, section 3 of the Private Hire Vehicles (London) Act 1998, or a provision of a local enactment equivalent to the provision mentioned in sub-paragraph (i) or (ii); and in section 167A, also includes a person who holds a licence under Part I of the Civic Government (Scotland) Act 1982 in relation to the use of premises for the carrying on of a business which consists to any extent of the taking of bookings, by any means of communication, from members of the public for the hire… Section 173(1)

authorised person — a person authorised by the Secretary of State for the purposes of that subsection Section 177(9)

B's terms — — the terms of B's employment, the terms on which the principal allows B to do the contract work, the terms on which B has the position as a partner or member, or the terms of B's appointment to the office Schedule 9, Part 3, paragraph 19(5)

Charitable instrument — an instrument establishing or governing a charity (including an instrument made or having effect before the commencement of this section) Section 194(4)

Chief officer — — in relation to an appointment under a relevant Act, the chief officer of police for the police force to which the appointment relates; in relation to any other appointment, the person under whose direction and control the body of constables or other persons to which the appointment relates is; in relation to a constable or other person under the direction and control of a chief officer of police, that chief officer of police; in relation to any other constable or any other person, the person under whose direction and control the constable or other person is Section 43(2)

child — a person who has not attained the age of 18 Section 86(5)

Civil marriage — marriage solemnised otherwise than according to the rites of the Church of England or any other religious usages Section 202(4)

common parts — in relation to premises, the structure and exterior of, and any common facilities within or used in connection with, the building or part of a building which includes the premises but only in so far as the structure, exterior and common facilities are not solely owned by the owner of the premises Section 37(5)

Comparable persons — — in relation to section 39(2) or (4), the other employees; in relation to section 41(1) or (3), the other contract workers supplied to the principal; in relation to section 44(2) or (6), the other partners of the firm; in relation to section 45(2) or (6), the other members of the LLP; in relation to section 49(6) or (8) or 50(6), (7), (9) or (10), persons holding offices or posts not materially different from that held by B Schedule 9, Part 3, paragraph 19(4)

Court — — in relation to proceedings in England and Wales, the county court; in relation to proceedings in Scotland, the sheriff Section 140(6)

Criminal matter — — an investigation into the commission of an alleged offence; a decision whether to commence criminal proceedings; criminal proceedings Section 141(9)

designated — designated by order made by the appropriate authority; “hire car” has such meaning as is prescribed by the appropriate authority; “operator”, in relation to a transport facility, means a person who is concerned with the management or operation of the facility Section 162(3)

disabled person — a person who is a disabled person for the purposes of the 2010 Act; and section 89 (interpretation of Part 6) of, and paragraph 6 of Schedule 10 (supplementary provisions for Schedule 10) to, the 2010 Act apply for the purposes of subsection (6)(b) as they apply for the purposes of Part 6 of and Schedule 10 to that Act Schedule 26, Part 1, paragraph 36(3)

driver — a person who holds a licence under— section 13 of the Private Hire Vehicles (London) Act 1998 ..., section 51 of the Local Government (Miscellaneous Provisions) Act 1976 ..., or an equivalent provision of a local enactment; “licensing authority”, in relation to any area in England and Wales, means the authority responsible for licensing private hire vehicles in that area; ... .. Employment — — employment under a contract of employment, a contract of apprenticeship or a contract personally to do work; Crown employment; employment as a relevant member of the House of Commons staff; employment as a relevant member of the House of Lords staff Section 83(2)

enactment — an enactment contained in— an Act of Parliament, an Act of the Scottish Parliament, an Act or Measure of the National Assembly for Wales, or subordinate legislation Section 212(1)

equality clause — a sex equality clause or maternity equality clause Section 212(1)

equality rule — a sex equality rule or maternity equality rule Section 212(1)

equivalent compulsory maternity leave — a period of leave— which is of a substantially similar nature (regardless of its length) to compulsory maternity leave, and which is provided for under a statutory or contractual scheme Section 18(6A)

estate agent — a person who, by way of profession or trade, provides services for the purpose of— finding premises for persons seeking them, or assisting in the disposal of premises Schedule 5, paragraph 1(5)

Group insurance arrangement — an arrangement between an employer and another person for the provision by that other person of facilities by way of insurance to the employer's employees (or a class of those employees) Section 148(3)

Guaranteed minimum pension provisions — so much of the Pension Schemes Act 1993 and of any other enactment as relates to guaranteed minimum pensions (within the meaning of that Act) Section 66(6)

Immigration and nationality functions — functions exercisable by virtue of— the Immigration Acts (excluding sections 28A to 28K of the Immigration Act 1971 so far as they relate to criminal offences), the British Nationality Act 1981, the British Nationality (Falkland Islands) Act 1983, the British Nationality (Hong Kong) Act 1990, the Hong Kong (War Wives and Widows) Act 1996, the British Nationality (Hong Kong) Act 1997, the Special Immigration Appeals Commission Act 1997, or anything which forms part of assimilated law and was made under section 2(2) of, or paragraph 1A of Schedule 2 to, the European Communities Act 1972 or forms part of assimilated law by virtue of section 3 of the European Union (Withdrawal) Act 2018 and (in either case) relates to the subject matter of an enactment within paragraphs (a) to (g) Schedule 18, paragraph 2(2)

improvement — an alteration in or addition to the premises and includes— an addition to or alteration in the landlord's fittings and fixtures; an addition or alteration connected with the provision of services to the premises; the erection of a wireless or television aerial; carrying out external decoration; “lease” includes a sub-lease or other tenancy, and “landlord” and “tenant” are to be construed accordingly; “protected tenancy” has the same meaning as in section 1 of the Rent Act 1977; “statutory tenancy” is to be construed in accordance with section 2 of that Act; “secure contract” has the same meaning as in the Renting Homes (Wales) Act 2016 (anaw 1) (see section 8 of that Act); “secure tenancy” has the same meaning as in section 79 of the Housing Act 1985 Section 190(9)

Information society service — borrowed from another act; this instrument states no meaning of its own Schedule 25, paragraph 7(2)

Insurance business — business which consists of effecting or carrying out contracts of insurance; and that definition is to be read with— section 22 of the Financial Services and Markets Act 2000, any relevant order under that Act, and Schedule 2 to that Act Schedule 3, Part 5, paragraph 21(2)

licensed premises — premises in respect of which a relevant premises licence within the meaning of section 19A of the Licensing Act 2003 (mandatory conditions where alcohol sold) has effect Schedule 3, Part 7, paragraph 30C(4)

licensing authority — — in relation to the area to which the Metropolitan Public Carriage Act 1869 applies, Transport for London; in relation to any other area in England and Wales, the authority responsible for licensing taxis in that area Section 169(5)

Local authority — — in relation to England, an English local authority within the meaning of section 162 of the Education and Inspections Act 2006; in relation to Wales, a Welsh local authority within the meaning of that section Section 89(10)

mobile home rental agreement — an agreement (other than an arrangement to occupy a mobile home for the purposes of a holiday) under which a person (“ the occupier ”) is entitled to occupy a mobile home on the protected site as the occupier's residence whether for a specified period or for successive periods of a specified duration subject to payment of money and the performance of other obligations Schedule 3, Part 7, paragraph 30D

mobility aids — any item the passenger uses to assist with their mobility but does not include— a wheelchair, or an assistance dog (sections 168 and 170 make provision about the carrying of assistance dogs) Section 164A(6)

Police cadet — a person appointed to undergo training with a view to becoming a constable Section 43(4)

prescribed system — a system using a mode of guided transport (“guided transport” having the same meaning as in the Transport and Works Act 1992) that is specified in rail vehicle accessibility regulations; “railway” and “tramway” have the same meaning as in the Transport and Works Act 1992. “trans-European rail system” has the meaning given in regulation 2(1) of the Railways (Interoperability) Regulations 2011 Section 182(5)

Proposed firm — persons proposing to form themselves into a partnership Section 46(3)

public authority — an authority that has functions of a public nature Section 2(2)

Recruitment — a process for deciding whether to— offer employment to a person, make contract work available to a contract worker, offer a person a position as a partner in a firm or proposed firm, offer a person a position as a member of an LLP or proposed LLP, offer a person a pupillage or tenancy in barristers' chambers, take a person as an advocate's devil or offer a person membership of an advocate's stable, offer a person an appointment to a personal office, offer a person an appointment to a public office, recommend a person for such an appointment or approve a person's appointment to a public office, or offer a person a service for finding employment Section 159(5)

regulated public service vehicle — a public service vehicle to which PSV accessibility regulations are expressed to apply. adapted to carry more than 8 passengers, and a public service vehicle for the purposes of the Public Passenger Vehicles Act 1981 Section 174(3)

relevant Scottish marriage — a religious or belief marriage ... within the meaning of section 8(2)(a) of the Marriage (Scotland) Act 1977 Schedule 3, Part 6B, paragraph 25B(6)

Religious premises — premises which— are used solely or mainly for religious purposes, or have been so used and have not subsequently been used solely or mainly for other purposes Section 202(4)
