agency worker — an individual—
who has a worker’s contract or an arrangement with a work-finding agency by virtue of which the individual is (or is to be) supplied to work for and under the supervision and direction of another person,
who does not do (or is not to do) the work under a worker’s contract with the other person, and
who is not (or is not to be) a party to a contract under which the individual undertakes to do the work for another party to the contract whose status is, by virtue of the contract, that of a client or customer of any profession or business undertaking carried on by the individual Section 27BV(1)
agency worker — a worker supplied by a person (the “agent”) to do work for another person (the “principal”) under a contract or other arrangement between the agent and principal;
“ compulsory school age ” has the meaning given in section 8 of the Education Act 1996;
“ school age ” has the meaning given in section 31 of the Education (Scotland) Act 1980 Section 63D(9)
agricultural wages order — an order made under—

in a case within paragraph (a) of that subsection, extended beyond the time of expiry by an additional period equal to the proposed period of extension, and
in a case within paragraph (b) of that subsection, extended beyond the time of expiry up to the end of the day (or last of the days) on which he attends at his proper or usual place of work and is ready and willing to work Section 143(8)
available day within the proposed period of extension — an available day which begins before the end of the proposed period of extension,
“time of expiry”, in relation to a notice of termination, means the time at which the notice would expire apart from section 143, and
“working day”, in relation to an employee, means a day on which, in accordance with his contract of employment, he is normally required to work Section 144(3)
bereaved employee — an employee who—

betting work — —
work which consists of or includes dealing with betting transactions at a track in England or Wales and which is carried out for a person who holds a general betting operating licence, a pool betting operating licence or a horse-race pool betting operating licence, and
work on premises in respect of which a betting premises licence has effect at a time when the premises are used for betting transactions Section 233(2)
betting worker — an employee who under his contract of employment is or may be required to do betting work Section 233(1)
carer’s leave — leave under section 80J Section 235(1)
cash shortage — a deficit arising in relation to amounts received in connection with retail transactions Section 17(1)
catering business — —
and in paragraph (a) “alcohol” has the same meaning as in the Licensing Act 2003 .
the sale of meals, refreshments or alcohol... for consumption on the premises on which they are sold, or
the sale of meals or refreshments prepared to order for immediate consumption off the premises; except that in Scotland “alcohol” has the meaning given in section 2 of the Licensing (Scotland) Act 2005 Section 232(7)
certificate of independence — a certificate issued under section 6 of the Trade Union and Labour Relations (Consolidation) Act 1992 Section 27BZ1(2)
child — a person under the age of 18 (see also section 80EE for the application of this Chapter in relation to stillbirths after twenty-four weeks of pregnancy) Section 80EA(9)
childbirth — the birth of a living child or the birth of a child whether living or dead after twenty-four weeks of pregnancy,
“collective agreement” has the meaning given by section 178(1) and (2) of the Trade Union and Labour Relations (Consolidation) Act 1992 Section 235(1)
commencement date — the date appointed by regulations under section 44 of the Enterprise Act 2016 for the coming into force of section 33 of, and Schedule 5 to, that Act Section 41C(7)
company — —
a company or overseas company (within the meaning, in each case, of the Companies Act 2006) which has a share capital, or
a United Kingdom Societas (or UK Societas) within the meaning of Council Regulation 2157/2001/EC of 8 October 2001 on the Statute for a European company;
“ drag-along rights ”, in relation to shares in a company, means the right of the holders of a majority of the shares, where they are selling their shares, to require the holders of the minority to sell theirs;
“ parent undertaking ” has the same meaning as in the Companies Act 2006;
“ relevant independent adviser ” has the meaning that it has for the purposes of section 203(3)(c);
“ tag-along rights ”, in relation to shares in a company, means the right of the holders of a minority of the shares to sell their shares, where the holders of the majority are selling theirs, on the same terms as those on which the holders of the majority are doing so Section 205A(13)
conciliation officer — an officer designated by the Advisory, Conciliation and Arbitration Service under section 211 of that Act Section 235(1)
contract — a contract whether express or implied and (if it is express) whether oral or in writing Section 104K(8)
contract of employment — a contract of service or apprenticeship, whether express or implied, and (if it is express) whether oral or in writing Section 230(2)
cross-boundary petroleum field — a petroleum field that extends across the boundary between the United Kingdom sector of the continental shelf and a foreign sector of the continental shelf Section 201(5)
Crown employment — employment under or for the purposes of a government department or any officer or body exercising on behalf of the Crown functions conferred by a statutory provision Section 191(3)
date of the act — the first day of that period, and
a deliberate failure to act shall be treated as done when it was decided on Section 45(10)
date of the act — the last day of that period, and
a deliberate failure to act shall be treated as done when it was decided on Section 48(4)
date of the request — the date that the request is received by the employer Section 27J(11)
day — the period of twenty-four hours from midnight to midnight Section 28(4)
dependant — in relation to an employee—
a spouse or civil partner ,
a child,
a parent,
a person who lives in the same household as the employee, otherwise than by reason of being his employee, tenant, lodger or boarder Section 57A(3)
discrimination — discrimination within any of sections 13, 15 to 19A and 21(2) of the Equality Act 2010 Section 202A(10)
dismissal procedures agreement — an agreement in writing with respect to procedures relating to dismissal made by or on behalf of one or more independent trade unions and one or more employers or employers’ associations,
“employers’ association” has the same meaning as in the Trade Union and Labour Relations (Consolidation) Act 1992 Section 235(1)
employee — an individual who has entered into or works under (or, where the employment has ceased, worked under) a contract of employment Section 230(1)
English local authority — —
a county council or district council in England;
a London borough council;
the Greater London Authority;
the Council of the Isles of Scilly;
the Common Council of the City of London in its capacity as a local authority, a police authority or a port health authority;
a combined authority established under section 103 of the Local Democracy, Economic Development and Construction Act 2009;
a combined county authority established under section 9(1) of the Levelling-up and Regeneration Act 2023 Section 104I(12)
English local authority — —
a county council or district council in England;
a London borough council;
the Greater London Authority;
the Council of the Isles of Scilly;
the Common Council of the City of London in its capacity as a local authority, a police authority or a port health authority;

excluded worker — a worker who is of a specified description Section 27BA(16)
existing employee — an employee whose employment with his employer began on or after 30th November 1993 and before 6th April 2020 Schedule 2, Part I, paragraph 7A(1)
expected week of childbirth — the week, beginning with midnight between Saturday and Sunday, in which it is expected that childbirth will occur,
“guarantee payment” has the meaning given by section 28 Section 235(1)
external qualification — an academic or vocational qualification awarded or authenticated by such person or body as may be specified in or under regulations made by the Secretary of State.
would contribute to the attainment of the standard prescribed for the purposes of subsection (1)(c), and
would be likely to enhance the employee’s employment prospects (whether with his employer or otherwise) Section 63A(2)
foreign sector of the continental shelf — an area outside the territorial waters of any state, within which rights with respect to the sea-bed and subsoil and their natural resources are exercisable by a state other than the United Kingdom Section 201(5)
harassment — harassment of the kind described in subsection (1), (2) or (3) of section 26 of that Act Section 202A(10)
independent monitoring board — a board appointed under section 6(2) of the Prison Act 1952 Section 50(7)
independent trade union — a trade union which—
is not under the domination or control of an employer or a group of employers or of one or more employers’ associations, and
is not liable to interference by an employer or any such group or association (arising out of the provision of financial or material support or by any other means whatever) tending towards such control,
“job”, in relation to an employee, means the nature of the work which he is employed to do in accordance with his contract and the capacity and place in which he is so employed,
“local authority”, in relation to the placement of children under section 22C of the Children Act 1989, has the same meaning as in that Act (see section 105(1) of that Act);
“local authority foster parent” has the same meaning as in the Children Act 1989 (see section 22C(12) section 105(1) of that Act) Section 235(1)
large shop — a shop which has a relevant floor area exceeding 280 square metres;
“objection notice” has the meaning given in section 41A(2) Section 43ZB(1)
live birth — the birth of a child born alive Section 80EA(9)
local authority — —
an English local authority,
a Welsh local authority, or
a Scottish local authority Section 104I(12)

“position”, in relation to an employee, means the following matters taken as a whole—
his status as an employee,
the nature of his work, and
his terms and conditions of employment,
“protected disclosure” has the meaning given by section 43A,
“redundancy payment” has the meaning given by Part XI,
“relevant date” has the meaning given by sections 145 and 153,
“renewal” includes extension, and any reference to renewing a contract or a fixed term shall be construed accordingly,
“section 63D application” has the meaning given by section 63D(2) Section 235(1)
payment arrangement — an arrangement between an employer and another person under which payments made by customers of the employer are to be received by the other person instead of the employer Section 27C(9)
period of notice — —
where notice is given by an employer, the period of notice required by section 86(1), and
where notice is given by an employee, the period of notice required by section 86(2) Section 87(3)
petroleum field — a geological structure identified as an oil or gas field by the Order in Council concerned Section 201(5)
police service — —
service as a member of a constabulary maintained by virtue of an enactment, or
subject to section 126 of the Criminal Justice and Public Order Act 1994 (prison staff not to be regarded as in police service), service in any other capacity by virtue of which a person has the powers or privileges of a constable Section 200(2)
pre-termination negotiations — any offer made or discussions held, before the termination of the employment in question, with a view to it being terminated on terms agreed between the employer and the employee Section 111A(2)
pre-TURERA employee — an employee whose employment with his employer began before 30th November 1993 (the day on which section 26 of the Trade Union Reform and Employment Rights Act 1993 came into force), whether or not the provisions of sections 1 to 6 of the Employment Protection (Consolidation) Act 1978, as they had effect before the substitution made by that section, applied to him before that date Schedule 2, Part I, paragraph 7(1)
pregnancy loss — —
the ending of a pregnancy after less than twenty-four weeks of pregnancy in any way other than by a live birth, or
the failure of an embryo to become implanted following a transfer carried out in the course of providing treatment services within the meaning of the Human Fertilisation and Embryology Act 1990 Section 80EA(9)
prescribed — prescribed by regulations made by the Secretary of State Section 75(2)
prescribed — prescribed by regulations made by the Secretary of State Section 75D(2)
prescribed — prescribed by regulations made by the Secretary of State Section 99(2)
probationary period — a temporary period specified in the contract of employment or other worker’s contract between a worker and an employer that—
commences at the beginning of the employment, and
is intended to enable the employer to assess the worker’s suitability for the employment Section 1(6)
protected disclosure — a qualifying disclosure (as defined by section 43B) which is made by a worker in accordance with any of sections 43C to 43H Section 43A
public place of business — a place of business where interaction between—
occurs wholly or mainly face-to-face.
customers of the employer, and

public sector employer — a person that—
is wholly or mainly funded from public funds,
is under a statutory duty to carry out any functions of a public nature, and
so far as carrying out those functions, does not operate on a commercial basis;
“recognised”, in relation to a trade union, has the same meaning as in the Trade Union and Labour Relations (Consolidation) Act 1992 (see section 178 of that Act) Section 104I(12)
public sector employer — a person that—
is wholly or mainly funded from public funds,
is under a statutory duty to carry out any functions of a public nature, and
so far as carrying out those functions, does not operate on a commercial basis;
“recognised”, in relation to a trade union, has the same meaning as in the Trade Union and Labour Relations (Consolidation) Act 1992 (see section 178 of that Act) Section 104K(8)
qualified lawyer — —
as respects England and Wales, a person who, for the purposes of the Legal Services Act 2007, is an authorised person in relation to an activity which constitutes the exercise of a right of audience or the conduct of litigation (within the meaning of that Act), and
as respects Scotland, an advocate (whether in practice as such or employed to give legal advice), or a solicitor who holds a practising certificate Section 203(4)
qualifying disclosure — any disclosure of information which, in the reasonable belief of the worker making the disclosure, is made in the public interest and tends to show one or more of the following—
that a criminal offence has been committed, is being committed or is likely to be committed,
that a person has failed, is failing or is likely to fail to comply with any legal obligation to which he is subject,
that a miscarriage of justice has occurred, is occurring or is likely to occur,
that the health or safety of any individual has been, is being or is likely to be endangered,
that sexual harassment has occurred, is occurring or is likely to occur,
that the environment has been, is being or is likely to be damaged, or
that information tending to show any matter falling within any one of the preceding paragraphs has been, is being or is likely to be deliberately concealed Section 43B(1)
qualifying reason — —
a reason of the type mentioned in section 98(1)(b), or
in relation to a worker who was not an employee immediately before ceasing to be employed, a reason that would be of the type mentioned in section 98(1)(b) if references in that provision and in section 98(2) and (3) to an employee were references to a worker;
“the response period”, in relation to a guaranteed hours offer made to a qualifying worker, means the period—
beginning with the day after the day on which the offer is made, and
ending with the specified day Section 27BD(13)
qualifying tips, gratuities and service charges — —
employer-received tips, and
worker-received tips which—
are subject to employer control, or
are connected with any other worker-received tips which are subject to employer control Section 27C(2)
redundancy case — a case where paragraphs (a) and (b) of subsection (1) of this section are satisfied Section 105(9)
reference period — a period of at least one day, as determined by the employer from time to time Section 27F(9)

relevant contract — any contract, other than a contract of employment, whether express or implied and (if express) whether oral or in writing, by which an individual undertakes to do or perform (whether personally or otherwise) any work or services for another party to the contract whose status is by virtue of the contract that of a client or customer of any profession or business undertaking carried on by the individual Section 202A(6)
relevant date — the date on which the employee’s notice to terminate his contract of employment expires Section 145(3)

relevant intervention direction — —

relevant member of the House of Lords staff — any person who is employed under a contract of employment with the Corporate Officer of the House of Lords Section 194(6)
relevant occupational pension scheme — an occupational pension scheme (as defined in section 1 of the Pension Schemes Act 1993) established under a trust Section 102(2)
relevant occupational pension scheme — an occupational pension scheme (as defined in section 1 of the Pension Schemes Act 1993) established under a trust Section 46(3)
relevant occupational pension scheme — an occupational pension scheme (as defined in section 1 of the Pension Schemes Act 1993) established under a trust, and
references to the employer, in relation to such a scheme, are to an employer of persons in the description or category of employment to which the scheme relates , and
references to training are to training on the employer’s premises or elsewhere Section 58(3)
relevant period — the period determined by section 43ZA(2) (but subject to section 41D(3)) Section 101ZA(5)
relevant period — the period determined by section 43ZA(2) (but subject to section 41D(3)) Section 45ZA(10)
relevant person — —
a person who, in connection with an employee's claim to be entitled to leave under section 75E or 75G, is required to satisfy conditions specified in provision under section 75E(2) or (5) or 75G(2) or (5), or

relevant qualification — an external qualification the attainment of which—
and for the purposes of paragraph (c) Section 63A(2)
relevant recommendation — a recommendation in a specified provision of a code of practice issued or approved under section 16 of the Health and Safety at Work etc. Act 1974 Section 66(2)
relevant requirement — a requirement imposed by or under a specified provision of an enactment or of an instrument made under an enactment Section 66(2)
relevant tips — the qualifying tips, gratuities and service charges that—
are paid at, or are otherwise attributable to, a place of business of an employer, and
are paid during a reference period Section 27F(1)
response period — the period of four weeks beginning with the date of the request Section 27J(11)
restricted variation — any of the following—
a reduction of, or removal of an entitlement to, any sum payable to an employee in connection with the employment (but see subsection (6));
where the amount of any sum payable to an employee in connection with the employment is determined by reference to a measure of the amount of work done by the employee (including a measure referable to results achieved by the employee), a variation of that measure;
a variation of any term or condition relating to pensions or pension schemes;
a variation of the number of hours which an employee is required to work;
a variation of the timing or duration of a shift which meets such conditions as may be specified in regulations made by the Secretary of State;
a reduction in the amount of time off which an employee is entitled to take;
a variation of a description specified in regulations made by the Secretary of State;
the inclusion in a contract of employment of a term enabling the employer to make any variation within any of the preceding paragraphs without the employee’s agreement Section 104I(5)
Scottish local authority — a council constituted under section 2 of the Local Government etc. (Scotland) Act 1994 Section 104I(12)

service complaint — a complaint under section 334 of the Armed Forces Act 2006 Section 192(6A)
sexual harassment — harassment of the kind described in section 26(2) of the Equality Act 2010 (unwanted conduct of a sexual nature) Section 43L(1)
shared parental leave — leave under section 75E or 75G Section 235(1)
shop — any premises where there is carried on a trade or business consisting wholly or mainly of the sale of goods Section 43ZB(2)
shop work — work in or about a shop . . . on a day on which the shop is open for the serving of customers Section 232(2)
shop worker — an employee who, under his contract of employment, is or may be required to do shop work Section 232(1)
short notice — —
in relation to the cancellation of a shift, notice given less than a specified amount of time before the shift would have started (if the shift had not been cancelled);
in relation to the movement of a shift, or the movement and curtailment (at the same time) of a shift, notice given—
less than a specified amount of time before the earlier of when the shift would have started (if the shift had not been moved, or moved and curtailed) and when the shift is due to start (having been moved, or moved and curtailed);
on or after the start of the shift;
in relation to the curtailment of a shift where there is a change to when the shift is to start (but there is no movement of the shift), notice given less than a specified amount of time before the earlier of—
when the shift would have started (if there had not been the change), and
when the shift is due to start (the change having been made);
in relation to the curtailment of a shift where there is no change to when the shift is to start, notice given—
less than a specified amount of time before the shift is due to start;

“successor”, in relation to the employer of an employee, means (subject to subsection (2)) a person who in consequence of a change occurring (whether by virtue of a sale or other disposition or by operation of law) in the ownership of the undertaking, or of the part of the undertaking, for the purposes of which the employee was employed, has become the owner of the undertaking or part,
“trade union” has the meaning given by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1992,
“week”—
in Chapter I of this Part means a week ending with Saturday, and
otherwise, except in sections 27C, 75F, 75H, 80A, 80B , 80EA , 80EF , 80J and 86 and paragraph 11 of Schedule A1, means, in relation to an employee whose remuneration is calculated weekly by a week ending with a day other than Saturday, a week ending with that other day and, in relation to any other employee, a week ending with Saturday Section 235(1)
